Frequently Asked Questions

Which projects require Environmental Clearance in India?
Projects listed in Schedule I of the EIA Notification 2006 require prior Environmental Clearance before commencing any construction or operation. These include mining projects (above specified thresholds), industrial estates, thermal power plants, petroleum refineries, chemical plants, large real estate projects, airports, highways and many other categories. Category A projects are appraised at the national level by MoEFCC, while Category B projects are appraised by State Environment Impact Assessment Authorities (SEIAAs).
How long does the Environmental Clearance process typically take?
The timeline varies by project category and complexity. For Category B projects with standard baseline studies, the process typically takes 9–18 months from ToR application to clearance grant. Category A projects requiring national-level appraisal can take 18–36 months. Delays commonly arise from deficiency notices on EIA reports, public hearing objections, or EAC query resolution. Our experience significantly reduces unnecessary delays.
What is a Consent to Establish (CTE) and Consent to Operate (CTO)?
CTE (also called NOC) is issued by the State Pollution Control Board and is required before construction begins for units that will emit air or water pollutants. CTO is required before commencing operations. Both are issued under the Water Act and Air Act. They must be renewed periodically and are distinct from the Environmental Clearance granted by MoEFCC or SEIAA.
What is required for Hazardous Waste authorisation?
Facilities generating, storing, treating, or disposing of hazardous waste as listed under Schedule I of the Hazardous Waste Management Rules must obtain authorisation from the State PCB. Authorisation requires submission of details of hazardous waste types and quantities, storage arrangements, disposal methods and treatment facilities. Annual returns must be filed and the authorisation renewed every five years.
Can you help with obtaining Forest Clearance alongside Environmental Clearance?
Yes. Projects involving diversion of forest land require prior approval under the Forest (Conservation) Act 1980, processed through the concerned state forest department to MoEFCC. We coordinate Forest Clearance applications in parallel with the EC process and also support Wildlife Clearance requirements for projects within 10 km of Protected Areas under the Wildlife (Protection) Act.
